Article 2 The pollution-free agricultural product mark is a certification mark applied to the product that has obtained the certification of pollution-free agricultural products or its packaging.
The sign of pollution-free agricultural products referred to in these Measures is the national uniform pollution-free agricultural product certification mark.
The state encourages units and individuals that have obtained the certification of pollution-free agricultural products to actively use the national unified pollution-free agricultural product mark.
Article 3 The Ministry of Agriculture and the State Certification and Accreditation Regulatory Commission (hereinafter referred to as the China National Accreditation Administration) shall exercise unified supervision and management over the national unification of pollution-free agricultural product marks.
The administrative department of agriculture and the quality and technical supervision department of the local people's government at or above the county level shall be responsible for the supervision and inspection of pollution-free agricultural product marks within their own administrative areas in accordance with the division of duties.
Article 4 These Measures apply to the application, printing, distribution, use, and supervision of pollution-free agricultural product marks.
Article 5 The basic patterns, specifications and colors of pollution-free agricultural products are as follows:

Article 6 A certification body (hereinafter referred to as the certification body) that has acquired the certification of pollution-free agricultural products shall be responsible for accepting, reviewing, and issuing the application of the pollution-free agricultural product mark in accordance with the provisions of the "Administrative Measures for Pollution-free Agricultural Products".
Article 7 Any entity or individual that obtains a certificate for the certification of pollution-free agricultural products may apply to the certification body for a pollution-free agricultural product mark.
Article 8 The certification organization shall explain to the entities and individuals applying for the use of the pollution-free agricultural product mark the regulations for the management of pollution-free agricultural products, and guide and supervise its correct use of the pollution-free agricultural product mark.
Article 9 The certification body shall issue the sign of pollution-free agricultural products in accordance with the type and quantity of the products indicated in the certification, and the certification body shall establish a registration system for the storage of signs of pollution-free agricultural products. When the signs of pollution-free agricultural products are put into storage, they shall be counted and the registration accounts shall be registered; the records of pollution-free agricultural products shall be archived and stored for 5 years.
Article 10 The certification body shall report the release of the pollution-free agricultural product marks to the Ministry of Agriculture and the National Certification and Accreditation Administration every six months.
Article 11 Units and individuals that have obtained a pollution-free agricultural product certification certificate may add a pollution-free agricultural product mark to the product specified in the certificate or its packaging, in order to prove that the product meets the pollution-free agricultural product standard.
The signs of pollution-free agricultural products printed on packaging, labels, advertisements, and manuals cannot be used as signs of pollution-free agricultural products.
Article 12 Units and individuals that use the signs of pollution-free agricultural products shall use them within the product range and validity period stipulated in the pollution-free agricultural product certification, and may not use them beyond the scope or overdue period, and may not buy, sell or transfer.
Article 13 Units and individuals that use the signs of pollution-free agricultural products shall establish a system for the use and management of pollution-free agricultural products, and record and archive the use of pollution-free agricultural products.
Article 14 The printing of pollution-free agricultural product marks shall be undertaken by printing units that have passed the examination of the Ministry of Agriculture and the National Certification and Accreditation Administration of the People's Republic of China. No other entity or individual may print them without authorization.
Article 15 A printing unit that has no pollution agricultural product marks shall meet the following basic conditions:
(1) Having legally registered with the administrative department for industry and commerce and having a valid business certificate;
(2) Obtaining the license issued by relevant administrative departments such as the public security, press and publication;
(3) There are conditions such as technology, equipment, storage and storage facilities and other conditions that are compatible with the sign-printing business of pollution-free agricultural products;
(4) Having anti-counterfeiting technology and anti-counterfeit ability of pollution-free agricultural products;
(5) Having a sound management system;
(6) Other conditions that meet the relevant national regulations.
Article 16 The printing unit of the sign of pollution-free agricultural products shall print the sign of pollution-free agricultural products in accordance with the basic patterns, specifications and colors prescribed in these Measures.
Article 17 A printing unit that has no pollution-related agricultural product marks shall establish a registration system for the registration of non-environmental pollution-free agricultural products. When the sign of pollution-free agricultural products is put into storage, it shall be counted and the registration account shall be registered; the pollution-free agricultural product shall be filed with the sign of storage of agricultural products, and the period shall be 5 years.
The signs of non-environmental pollution of waste, residues and times should be destroyed and recorded.
Article 18 A printing unit that does not have a pollution-free agricultural product mark may not transfer the pollution-free agricultural product mark to any unit or individual other than a certification organization that has the qualification for the pollution-free agricultural product certification.
Article 19: Forgery, alteration, misappropriation, fraudulent use, purchase, sale and transfer of pollution-free agricultural product marks and violations of the provisions of these Measures shall be subject to administrative penalties in accordance with the relevant laws and regulations of the State; if a crime is constituted, criminal responsibility shall be investigated according to law.
Article 20: In the case of abuse of power, malpractice for self-interest, or negligence of duties by staff members engaged in the management of pollution-free agricultural product marks, administrative sanctions shall be imposed by the superior administrative department of the unit to which he belongs or the unit to which he belongs; and where a crime is constituted, criminal responsibility shall be investigated according to law.
Article 21 Any entity or individual that violates the provisions of these Measures may lodge a complaint with the certification body or directly to the Ministry of Agriculture or the CNCA.
Article 22 The Ministry of Agriculture and the National Certification and Accreditation Administration shall be responsible for the interpretation of these Measures.
Article 23 The present Measures shall be implemented as of the date of the announcement.
